Please note that Josefina LLC utilizes precious stones in many of its products, meaning any pre-order product may be subject to price changes or may become unavailable due to a shortage of such stones. The price charged for custom orders will be the price provided in the invoice sent to you by Josefina LLC. Price increases will only apply to orders placed after such changes have been made. Customers will be informed via email if any custom stones or materials requested in a custom order become unavailable or are subject to a price change.
Posted prices do not include taxes or charges for shipping and handling. These additional costs will be added to your merchandise total and itemized in your shopping cart and order confirmation email. While we strive to display accurate pricing information, occasional typographical errors, inaccuracies, or omissions related to pricing and availability may occur. We reserve the right to correct any such errors at any time and to cancel any orders arising from these occurrences.

VI. Shipping, Delivery, Title, and Risk of Loss
We offer worldwide shipping to ensure our products reach customers wherever they are. International customers are responsible for any applicable customs duties, taxes, or fees imposed by their country of residence. These charges are not included in the product price or shipping cost and must be settled directly with the relevant authorities.
We will arrange for the shipment of products to the address provided during the ordering process. Specific delivery options and timeframes can be found on the individual product pages. You are responsible for paying all shipping and handling charges specified at checkout, which include costs incurred for processing, handling, packing, shipping, and delivery of your order.
Title to the products and the risk of loss or damage passes to you upon our transfer of the products to the carrier. Once the products leave our care, the carrier assumes responsibility for the shipment, and we cannot be held liable for any loss, damage, or delays that may occur during transit.
Shipping and delivery dates provided are estimates only and cannot be guaranteed. While we strive to meet these timelines, we are not liable for delays caused by circumstances beyond our control.
VII. Returns, Refunds, and Exchanges
Final Sale Items:
All customizable, made-to-order, and pre-ordered items are considered final sales and are not eligible for return or exchange, except in cases of manufacturing defects.
Exchange Policy:
Josefina LLC products may be exchanged for a different colored stone, metal, or size, provided the desired item is in stock. If the requested item is not in stock, you may pre-order the exchange and return the unworn original item after completing payment for the exchange shipping label and the new order.
For Cattina© Products:
Exchanges are limited to in-stock items of different colored stones, metals, or sizes. If no stock is available, you may pre-order your exchange following the same procedure. Customers are responsible for shipping costs associated with exchanges unless the exchange is due to an error by Josefina LLC.

Return Shipping:
- Exchanges: Return shipping is free if the exchange is due to an error on our part.
- Refund Requests: Customers are responsible for return shipping costs for refund requests.
Resizing:
Resizing is available for certain products. To inquire about eligibility, please contact our support team at contact@josefinabailleres.com and include your order number. Approved resizing requests will incur shipping and handling charges, and production may take 1–2 months to complete.
Damaged or Defective Items:
If a package or item arrives damaged, please refuse the shipment and notify us immediately at contact@josefinabailleres.com. Claims for damaged or missing items must be reported within five days of receipt.
No Refunds for Non-Defective Items:
Custom orders and personalized items are not eligible for refunds or exchanges unless they arrive defective.
VIII. Limited Warranty and Repair Policy
Josefina LLC offers a 30-day limited warranty for all fine and high jewelry purchases. This warranty protects against specific manufacturing defects and outlines the terms for repair requests.
Warranty Coverage
This warranty covers:
- Manufacturing Defects, such as loose prongs, missing pavé stones, broken clasps, or broken soft chains.
- Stone Security: If a stone becomes loose due to a manufacturing issue, adjustments within the warranty period are provided free of charge.
Jewelry Maintenance Reminder:
Jewelry is similar to owning a car—it requires regular care and maintenance to remain in optimal condition. Just as car owners check the engine, tires, and oil regularly, wearers must inspect their jewelry’s prongs, settings, and bezels at least once a year. This upkeep ensures longevity and prevents avoidable damage. Josefina LLC offers resources on how to care for your jewelry and invites you to email contact@josefinabailleres.com with questions or concerns.
Warranty Exclusions
The warranty does not cover:
- Normal Wear and Tear: Scratches, dents, tarnishing, stretched or kinked chains, misshapen bands.
- Accidental Damage: Damage caused by misuse, exposure to chemicals, or neglect.
- Lost or Stolen Items: Jewelry that has been lost or stolen.
- Unauthorized Alterations: Repairs conducted by third parties.
- Counterfeit Products: Items not purchased directly from Josefina LLC or authorized retailers.
Repairs at Our Discretion
Repairs outside the warranty period are handled at Josefina LLC’s discretion. Customers must cover all associated costs, including replacement stones and shipping.
Typical Costs:
- Resizing: Starting at $70 USD, plus insured shipping (minimum $200 total for roundtrip shipping, which varies based on value).
- Other Repairs: Starting at $100 USD (e.g., fallen stones, missing prongs, polishing). Complex repairs may incur additional charges.
Replacement Stones:
Customers are responsible for the cost of any replacement stones required during repairs. Josefina LLC reserves the right to refuse repairs if replacement stones are unavailable or the cost is deemed unreasonable.
Repair Process and Costs
Steps for Repair Requests:

- Evaluation: We will determine if the damage qualifies as a manufacturing defect or requires paid repairs.
- Cost Approval: For non-warranty repairs, a quote will be provided. Customers must approve additional costs before work begins.
- Shipping Instructions: Approved repairs will receive detailed shipping guidelines. Insured shipping is recommended for valuable items.
- Repair Completion: Repairs typically take 1–3 months, depending on complexity. Once completed, the item is returned to you.
Pricing and Market Fluctuations:
Due to inflation and fluctuations in the market, repair costs, including materials and labor, may vary at the time of repair. The pricing for repairs or replacement parts (such as stones) may differ from the original price of the piece. Updated quotes will be provided before proceeding, and customers must approve these costs.
Shipping Costs:
- Warranty Repairs: Covered by Josefina LLC if the defect is within the warranty period.
- Non-Warranty Repairs: Customers are responsible for all shipping fees, including sending and receiving the item.
Limitation of Liability
The 30-day limited warranty constitutes the sole warranty from Josefina LLC. No other warranties, expressed or implied, are provided, including warranties of merchantability or fitness for a particular purpose.
- Maximum Liability: Josefina LLC's liability is limited to the amount paid for the product.
- Exclusions: Josefina LLC is not liable for indirect or consequential damages, such as lost profits or business interruptions.
Some jurisdictions do not allow exclusions or limitations on implied warranties or incidental, consequential, or other damages, so the above exclusions and limitations may not apply.
IX. Liability for Wear and Tear
Josefina LLC is not liable for any damages resulting from normal wear and tear, misuse, or unauthorized alterations of our jewelry. X. Material-Specific Policies
Soft Stones:
Soft stones, such as opals, pearls, emeralds, turquoise, or any stone below 6–7 on the Mohs hardness scale, require special care due to their delicate nature. They are more susceptible to scratches, chips, and other forms of wear. Avoid exposure to harsh chemicals and store them separately to prevent damage.
Hard Stones:
Hard stones, such as diamonds and sapphires, are more durable but still require proper maintenance to retain their brilliance. Regular cleaning with appropriate jewelry cleaners is recommended. Avoid exposing hard stones to extreme temperatures or abrasive surfaces.
Metal Care:
Different metals used in our jewelry require specific care to maintain their appearance and integrity. Refer to our Metal Care Guide for detailed instructions on how to care for gold, silver, platinum, and other metals used in our pieces.

Governing Law and Jurisdiction
These Terms and Conditions, as well as any matter arising out of or relating to them, including but not limited to the purchase, use, or access of products, services, or content provided by Josefina LLC, are governed by and construed in accordance with the internal laws of the State of New York, without regard to any choice or conflict of law provisions or rules (whether of the State of New York or any other jurisdiction) that would result in the application of the laws of any jurisdiction other than those of the State of New York.
Any disputes arising out of or relating to these Terms, or the transactions contemplated herein, shall be subject to the exclusive jurisdiction of the federal and state courts located in New York, NY. The Client expressly waives any objection to the personal jurisdiction and venue of such courts and further waives any defense of inconvenient forum.
Dispute Resolution
Good Faith Negotiations or Mediation
The parties shall first attempt to resolve any dispute through good faith negotiations or mediation. Either party may initiate mediation by providing written notice to the other party, specifying the nature of the dispute and requesting mediation. The mediation shall be conducted in New York, NY, and all related costs shall be shared equally by the parties unless otherwise agreed.
Binding Arbitration
If mediation fails to resolve the dispute within a reasonable time, the matter shall be submitted to binding arbitration, to be administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules then in effect. Arbitration shall take place in New York, NY, and the Federal Arbitration Act shall govern the interpretation and enforcement of this arbitration provision.
- Individual Arbitration Only: Arbitration shall be conducted on an individual basis. Neither the Client nor Josefina LLC shall have the right to join or consolidate claims by or against other parties, nor participate in any claim as a class representative, class member, or in a private attorney general capacity. The arbitrator shall have no authority to consider or resolve claims on a class-wide or collective basis.
- Arbitrator Authority: The arbitrator shall have exclusive authority to resolve any dispute relating to arbitrability, including enforceability, unconscionability, or validity of this arbitration provision. The arbitrator may award any relief available in court under law or equity.
- Final and Binding Award: The arbitrator’s decision shall be final and binding upon both parties, and judgment upon the award may be entered in any court of competent jurisdiction.
If any provision of this arbitration agreement is found unenforceable, such provision shall be severed, and the remaining arbitration terms shall remain in full force and effect.
Limitation of Actions
Any cause of action or claim arising out of or relating to these Terms and Conditions must be commenced within one (1) year after the cause of action accrues. Failure to bring such action within this period shall result in the permanent bar of such claims.
Force Majeure
Josefina LLC shall not be liable for any failure or delay in performance due to acts or circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, war, terrorism, civil unrest, governmental actions, labor disputes, supply chain disruptions, or utility outages. Such failure or delay shall not constitute a breach of these Terms and Conditions.
Limitation of Liability
In no event shall Josefina LLC be liable to the Client or any third party for consequential, indirect, incidental, special, exemplary, punitive, or enhanced damages, lost profits or revenues, or diminution in value, arising out of or related to the use or inability to use Josefina LLC’s products, services, or site content, regardless of foreseeability or advisement of such damages.
- Maximum Liability: Josefina LLC's maximum liability under these Terms shall be limited to the actual amount paid by the Client for the products or services in dispute.
- Exclusions: Josefina LLC is not liable for indirect or consequential damages, such as lost profits or business interruptions.
The limitation of liability set forth above shall:
(i) only apply to the extent permitted by law, and
(ii) not apply to (A) liability resulting from our gross negligence or willful misconduct, and (B) claims involving death or bodily injury caused by Josefina LLC.
XIV. Assignment
- By the Client: The Client may not assign or transfer any of their rights or delegate any of their obligations under these Terms and Conditions without prior written consent from Josefina LLC. Any attempted assignment or delegation without such consent shall be null and void.
- By Josefina LLC: Josefina LLC reserves the right to assign or transfer its rights and obligations under these Terms and Conditions to a third party without the Client’s consent.
XV. No Waivers
Failure by Josefina LLC to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
- Any waiver of any right or provision will only be effective if made in writing and signed by an authorized representative of Josefina LLC.
- A waiver of any specific breach or default does not constitute a waiver of any subsequent or other breach or default.
XVI. No Third-Party Beneficiaries
These Terms and Conditions are intended solely for the benefit of Josefina LLC and the Client. Nothing in these Terms and Conditions is intended to or shall confer any rights, benefits, or remedies upon any third party.
